It's not going to transfer data from one console to the other, it'll send a list of titles that you have bought from the DSiWare store so that the 3DS can re-download them, at least as far as I remember.

| So, no chance then. As Nintendo's 'fix' of SudokuHax was to simply remove it from the store.
